Welcome to Borsch Spot! We kindly ask you to carefully review these Terms and Conditions as they apply to the use of our website and mobile application (collectively referred to as the "Platform") for ordering food for self-pickup. By accessing or using the Platform, you agree to be bound by these terms. If you do not agree, please discontinue your use of the Platform immediately.

These Terms and Conditions form a legally binding agreement between you and Croizet Export Limited (referred to as “we,” “us,” “our,” or “Borsch Spot”), the operator of the Platform.

2. Use of the Platform

The Platform enables customers to browse our menu and place orders for food items, which are available for self-pickup only. We do not provide delivery services at this time.

By using the Platform, you agree that:

  • You are at least 18 years old, or you are using the Platform under the supervision of a parent or guardian who agrees to these Terms and Conditions.
  • You will provide accurate and complete details when placing your order.

3. Products and Services

Borsch Spot specializes in offering freshly prepared meals, including soups (e.g., borscht, lobster soup), main courses (e.g., goulash, duck with braised cabbage), and other dishes. All items are subject to availability.

We strive to ensure that our menu, product descriptions, and pricing are accurate. However, slight variations in presentation, ingredients, or availability may occur. Prices are subject to change without prior notice.

4. Payment

4.1 Payment Methods

Payments made through the Platform are instant payments (not subscription-based) and must be completed before your order is processed. We accept the following payment methods:

  • AlipayHK
  • QuickPass
  • WeChat Pay
  • Octopus
  • Credit/Debit Cards (Visa, MasterCard)
  • UnionPay ExpressPay

All payments are facilitated by trusted third-party payment service providers. Borsch Spot does not store your payment information. By providing your payment details, you authorize the payment service provider to process the transaction.

4.2 Third-Party Payment Providers

For online payments, we use third-party payment processing services. By placing an order, you agree to their terms and conditions, which govern the payment process. These third parties may have their own terms, conditions, and privacy policies.

5. Ordering and Self-Pickup

5.1 Placement of Orders

Orders placed via the Platform are binding. You are responsible for ensuring the accuracy of your order details, including the selected items, quantities, and pickup location. Once an order is confirmed, it cannot be modified.

5.2 Pickup Policy

All orders are for self-pickup only. You must collect your order from the designated Borsch Spot location within the specified time. Failure to pick up your order within a reasonable period may result in reduced food quality, for which Borsch Spot is not responsible. No refunds or replacements will be provided in such cases.

6. Refund/Cancellation Policy

6.1 Refund Policy

Refunds will only be considered in the following cases:

  • An incorrect item was prepared or provided.
  • The order was not successfully processed due to technical issues.

To request a refund, please contact us immediately via email at borschspot.hk@gmail.com or by phone at +852 37047081. Refunds will be issued at the sole discretion of Borsch Spot and may require proof of purchase.

6.2 Cancellation Policy

Orders cannot be canceled once they have been confirmed and payment has been processed. Please review your order carefully before confirming.

7. Promotions and Discounts

From time to time, Borsch Spot may offer promotional discounts or voucher codes through the Platform. These offers are valid only during the specified promotional period and are subject to individual terms and conditions. We reserve the right to modify, cancel, or reject any promotional offer without prior notice.

8. Intellectual Property

All contents of the Platform, including trademarks, logos, images, text, and graphics, are the property of Croizet Export Limited or its licensors. You may not copy, reproduce, or distribute any content from the Platform without prior written consent from Borsch Spot.

9. Limitation of Liability

To the extent permitted by law, Borsch Spot shall not be liable for any direct, indirect, incidental, or consequential damages resulting from:

  • The use or inability to use the Platform.
  • Delays or failures in performance due to circumstances beyond our reasonable control (e.g., internet outages, system failures).

Your sole remedy for dissatisfaction with the Platform is to discontinue its use.

10. Privacy Policy

Your personal information is collected and used in accordance with our Privacy Policy. By using the Platform, you consent to the collection, use, and processing of your data as described in our Privacy Policy.

11. Governing Law and Jurisdiction

These Terms and Conditions are governed by the laws of Hong Kong. Any disputes arising from or related to these Terms shall be subject to the exclusive jurisdiction of the courts of Hong Kong.

12. Changes to Terms and Conditions

Borsch Spot reserves the right to update these Terms and Conditions at any time without prior notice. Changes will be effective immediately upon posting to the Platform. Continued use of the Platform constitutes your acceptance of the revised Terms.
